Teenager who beat cancer killed in alleged drunk driving accident

Pedestrians in Las Vegas are always at risk along the roadways, but even more so during this time of the year. A Nevada man was recently arrested by North Las Vegas Police after he allegedly caused a fatal accident. A police report indicates that the apparent drunk driving accident happened in bright daylight soon after noon on a recent Tuesday.

Officials say a 16-year-old girl was walking along a local street when she was struck from behind by a car. The driver reportedly fled the scene, but he was later located and arrested. The victim's identity was not immediately made available. Her mother said that her daughter beat cancer when she was younger, only to be killed by an alleged drunk driver.

Officers determined that the driver was under the influence of alcohol when he struck the high school student. Along with a DUI charge, the 28-year-old driver is now facing several more charges. These include leaving the scene of an accident in which a fatality occurred.

While the family members of the teenager who died in this alleged drunk driving accident are struggling with the sad circumstances under which they lost their daughter, they will be entitled to pursue financial relief. A wrongful death claim may be filed in a Nevada civil court. This type of legal claim requires proof that the fatality was caused by the negligence of another party. Should the criminal charges result in a drunk driving conviction, that may be sufficient to establish negligence per se with regard to any separate claim for monetary damages.
