Fatal auto accident claims life of Nevada motorist

An auto accident can be the result of a wide range of causes, and accident victims can suffer in a variety of different ways. When an accident is the result of circumstances that were out of everyone's control, victims may be able to better accept the outcome. When an accident is the result of preventable recklessness, as is reportedly the case in a recent fatal Nevada auto accident, victims may choose to pursue justice in civil court.

The fatal crash occurred while two vehicles were in the same lane, one behind the other. The second vehicle was traveling at a higher rate of speed and attempted an unsafe lane change. The vehicle began to spin as the driver lost control, eventually striking the first vehicle. It then flipped, resulting in two of the passengers being thrown out of the SUV. One of the passengers died from his injuries at the scene of the accident.

The driver of the SUV was taken to a nearby hospital where he was treated for his injuries and then arrested. He has been officially charged with DUI with substantial bodily harm, DUI with death, involuntary manslaughter and possession of drug paraphernalia. He faces additional charges for driving without a valid license and improper lane change.

The reckless actions of the driver may be considered negligent under Nevada law. In these situations, the driver facing criminal charges for causing the auto accident may also face civil claims filed by those who have been impacted by the accident. The family of the deceased passenger may choose to file a wrongful death suit for the loss of their loved one, while the injured passenger may choose to seek compensation for injuries sustained in the accident.
