Shortly before 11 p.m. on a recent Wednesday, a person was killed in a collision on Interstate 80. According to the Nevada Highway Patrol, the incident occurred on the eastbound side of the interstate near Boomtown. The wreck remains under investigation while officials are trying to determine whether this was simply the actions of a negligent driver or whether drugs or alcohol was a factor.

The preliminary accident report indicates that a westbound pickup truck was traveling on Interstate 80 in the lanes carrying eastbound traffic. It reportedly crashed head-on into a sedan that was traveling east. The impact was said to have caused fatal injuries to an occupant in the sedan.

The victim was pronounced dead at the scene of the accident. The person who was driving the pickup truck suffered injuries of unknown severity, and he was rushed to a regional hospital. Troopers reported that it is not clear whether there were any other occupants except the two drivers in the vehicles. It is not known whether samples for toxicology tests were obtained, though that would be the normal procedure after a fatal accident.

The surviving family of the woman who died in this wrong-way crash may pursue claims for financial relief through the Nevada judicial system. A wrongful death lawsuit may be filed in a Nevada civil court; however, proving that a negligent driver was responsible for their loved one’s death may be challenging. Financial liability must be established before the court will adjudicate documented claims for economic losses along with emotional damages sustained.
